Imprint of real estate agent must mention regulatory authority

This summer, the Regional Court Leipzig ruled that, pursuant to the German Telemedia Act (Telemediengesetz – TMG), a real estate agent's duty to provide information (imprint) shall also comprise the indication of the regulatory authority. Who fails to do so does not only violate the TMG, but does also act contrary to fair competition. The Court considered this to be more serious than a mere petty offence. Indicating the regulatory authority would in particular protect consumers.
