More vacation time for persons 58 years of age and older

The German Federal Labour Court has recently decided: if an employer allows its older employees to have more vacation days per year than it does its younger employees,  treating older employees differently can be lawful when the different treatment is intended to protect the older employees. In reviewing whether such a vacation policy voluntarily implemented by the employer serves to protect its older employees and is appropriate, necessary, and reasonable for such protection, employers are entitled to an estimation regarding the specific situation at the company.
